İdarenin kuruluşuna, yapısına, işleyişine ve idarenin yerine getirdiği işlevin düzenlemesine ilişkin kuralları içerir. İdare Hukuku’nun konuları içerisinde idarenin kuruluşu önemli bir yer tutar. İdare tek yanlı ve iki yanlı olmak üzere iki tür işlem yapar. Tek yanlı idari işlemler; bireysel idari işlemler ve düzenleyici işlemler olmak üzere de tekrar ikiye ayrılır. İki yanlı idari işlemler ise idari sözleşmelerdir. İdarenin faaliyetleri açısından temel kavram kamu hizmetidir. Kamu düzenini sağlamaya yönelik kolluk hizmeti idarenin faaliyetleri arasında en önemlilerindendir.
